SPOTLIGHT

The Metropolitan Municipality of Lima reported that it is evaluating the termination of the concession agreement for the "Linea Amarilla" road project

The governmental entity announced that it is willing to terminate the concession agreement for the "Línea Amarilla" road project signed with Lamsac if the latter insists on maintaining the increase in tolls on the roads it manages.

From Sunday 21, the value of the toll in the concessioned road increased in PEN 0.40 for light vehicles and for heavy vehicles, the toll was established at PEN 5.70 per axis.

The general attorney of the municipality, Ricardo Rodriguez, explained that the entity has taken different actions after knowing the increase in tolls, the first being the requirement made to the concessionaire to immediately refrain from making the increase effective. The increase made is subject to an arbitration process and would constitute an arbitrary action by the private company.

If the decision to increase the tolls continues, the Municipality of Lima will be authorized to apply the sanction measures to Lamsac within the framework of the concession agreement, among which are contractual penalties and the expiration and unilateral termination of the agreement.

On the other hand, Lamsac  reported that the readjustment to the toll rate is an act foreseen in the concession agreement and that it is not arbitrary, contrary to what is indicated by the municipality. The purpose of this readjustment would be the collection of more resources for the maintenance of works, infrastructure and the realization of new investments.

SUNDAY 21

  • The Metropolitan Municipality of Lima obtained favorable ruling in litigation against the Jockey Club of Peru regarding a property of 16,900 m2 that will be used in the development of the construction project of the new "El Derby" road exchange (Gestión).


WEDNESDAY 17

  • Lima Airport Partners reported that to date there is still no final agreement on the delivery of the land necessary to execute the expansion project of the Jorge Chávez International Airport, due to the judicial process over ownership of necessary land (Gestión).

  • The Authority for Reconstruction reported that by the year 2019 US$ 2.2 billion will be allocated to the affected areas for the execution of projects (Gestión).


TUESDAY 16

  • The Metropolitan Municipality of Lima reported that it is evaluating, among other options, the termination of the concession agreement for the "Linea Amarilla" road project signed with Lamsac, since it considers the increase in tolls collection unjustified (Gestión).
